Section 6.60 of State Environmental Planning Policy (Biodiversity and Conservation) 2021 as amended by State Environmental Planning Policy Amendment (Water Catchments) 2022states that the Sydney catchment area, within the meaning of the Water NSW Act 2014, is declared to be the Sydney drinking water catchment.

The boundary is based on the Water NSW Act 2014, Schedule 2, clause 17 which provides that the Sydney catchment area is taken to be the area defined as the catchment area under the repealed Sydney Water Catchment Management Act 1998 (the repealed Act). Declarations under the repealed Act, section 41 were published in the Sydney Water Catchment Management (Catchment Areas) Order 1999 in the Government Gazette No 76 of 2 July 1999, pp 4648 and 4649. Additionally, the Sydney Water Catchment Management Amendment (Warragamba) Act 2006 deproclaimed an area of land declared to be special area below the Warragamba dam wall (assented to 4 December 2006). The Sydney Water Catchment Management (Prospect Special Area) Order 2008, as published in the Government Gazette No 92 of 25 July 1998 p 7326, declared the Prospect Special Area.

The effect of the above is that the boundary of the Sydney Drinking Water Catchment given effect by former State Environmental Planning Policy (Sydney Drinking Water Catchment) 2011 has been amended to align with the definition of the declared Sydney Drinking Water Catchment as provided under s 6.60 of State Environmental Planning Policy (Biodiversity and Conservation) 2021. The new boundary is largely the same as the former State Environmental Planning Policy (Sydney Drinking Water Catchment) 2011 except for the following changes:

  1. Inclusion of the hydrological catchment of Prospect Reservoir and Prospect Special Area to align the boundary with the description of the ‘inner catchment area’ and Prospect Special Area as published in the Sydney Water Catchment Management (Catchment Areas) Order 1999 and Sydney Water Catchment Management (Prospect Special Area) Order 2008 described above.

  2. Removal of the Special Area land below the Warragamba Dam Wall that was deproclaimed under the Sydney Water Catchment Management Amendment (Warragamba) Act 2006

  3. Where the ‘Special Area’ lands extend beyond the hydrological catchment boundary of the maps given effect under former State Environmental Planning Policy (Sydney Drinking Water Catchment) 2011, the catchment boundary is defined by the extent of the Special Area.

The boundary is effective from 21 November 2022 at the time State Environmental Planning Policy Amendment (Water Catchments) 2022 took effect.
